What Is an Estate Bond?

An estate bond is a surety bond that the court requires before granting authority to manage a deceased person’s assets. It protects beneficiaries and creditors from financial loss if the appointed trustee mismanages the estate.


You may also hear these referred to as probate bonds, fiduciary bonds, or executor bonds. The names differ, but they all serve the same purpose: a financial guarantee that the estate will be handled properly.


Three parties are involved in every estate bond:

  1. The Principal (you, the executor or administrator)
  2. The Obligee (the court)
  3. The Surety (the bonding company that backs
your obligation)

 

If you fail to carry out your duties and a valid claim is paid on the bond, the surety recovers those costs from you through the indemnity agreement. This is why an indemnity is always part of the application.

When Do You Need an Estate Bond?

Ontario’s Estates Act requires an administration bond in specific situations.
Other provinces have similar requirements. Here are the most common triggers:

Types of Estate Bonds We Handle

Administration Bond

Required when no will exists, or the will does not name the person applying as executor. This is the most common estate bond. It guarantees that you will administer the estate in accordance with the law, pay debts, and distribute assets to the correct beneficiaries.

Guardianship Bond

Required when someone is appointed to manage the financial affairs of a person who cannot do so themselves — a minor, an older adult, or someone who is incapacitated. The Office of the Public Guardian and Trustee or the court determines when this bond is needed and sets the bond amount.

Waiver of Probate Bond

Financial institutions sometimes require this bond to transfer assets (stocks, investment funds, or registered accounts) to the estate executor without requiring a full probate application. It provides the institution with a guarantee against future claims. Typically, less expensive and faster than a full estate bond.

Missing Beneficiary Bond

Required when a known beneficiary cannot be located after a reasonable search. The bond protects the estate against a future claim from the missing beneficiary after assets have been distributed to the other beneficiaries or the estate has been wound up.

Foreign Executor Bond

If you live outside of Canada or outside the court's jurisdiction, you need a foreign executor bond before the court will grant letters of probate or a Certificate of Appointment. How Much Does an Estate Bond Cost?

The premium is a percentage of the bond amount. In Ontario, the Estates Act sets the statutory bond amount at twice the value of the personal estate. The table below reflects the typical court-reduced bond amount on a standard file.

Typical rate range: 0.8% to 1% of the bond amount on a standard file.

What affects the rate:

  • Credit profile of the applicant.
  • Complexity of the estate.
  • Multiple properties, business interests, or outstanding litigation increase risk.
  • Bond amount. Larger estates may qualify for lower rates on a sliding scale.
  • Foreign indemnitors. If the executor lives outside Canada, the application requires additional underwriting, and the rate may reflect that.
  • Term length. Multi-year terms paid upfront may qualify for a premium discount.

Key cost facts:

  • The estate pays for the bond, not you personally. The executor typically pays the premium upfront and is reimbursed from the estate.
  • We request one-time fee structures from the surety where possible, rather than annual renewal premiums. This saves the estate money over the life of the bond.
  • Guardianship bonds are the exception — they are billed annually because the obligation is ongoing as long as the guardianship continues.
  • If a second-year term is purchased and the estate settles early, a pro-rated refund is typically available on the unused portion.

Estate Bond Questions, Answered

Q: What is the difference between an estate bond and life insurance?

They are completely different products. Life insurance pays a death benefit to a named beneficiary. An estate bond is a surety product that guarantees the executor will manage the estate properly. The bond protects beneficiaries and creditors from mismanagement — it is not an insurance policy in the traditional sense.

The estate pays. The executor typically pays the premium upfront and is reimbursed from the estate funds. You should not have to bear this cost personally.

An estate bond cannot be cancelled at the request of the executor alone. It remains in force until the estate has been fully administered. Closure typically requires one of the following: return of the original bond, a court order of discharge, or, where the surety permits soft closure, a letter from the law office confirming that all beneficiaries have received their distribution and that CRA tax clearance is in hand. The specific closure requirements are set out in the approval terms at the time the bond is issued.

Poor credit does not automatically disqualify you. In some cases, a co-applicant or co-indemnitor with stronger finances can be added to support the application. We work with multiple surety markets and can often find a path forward for applicants with credit challenges.
